Session II: Review of the experience gained in the implementation of the UN Set

Despite the commitment and accomplishments under the UN Set throughout the past 30 years, anticompetitive practices still persist at national, regional and international levels.

In particular cross-border competition cases and cases involving foreign market players pose certain challenges at the enforcement level, since it is difficult, if not impossible for a competition authority to gain access to evidence located abroad. Therefore, in 2008, member States decided in the Accra Accord to not only further validate the UN Set but to also facilitate the implementation of certain sections including international measures contained in its Section F.

This Section provides for voluntary consultations between member States when dealing with cross-border competition cases.

The first topic of this session is dedicated to this issue.

In addition, networking in the exchange of non-confidential information in facilitating cooperation among competition agencies can prove to be useful in addressing cross-border anticompetitive practices that harm consumers in different regional settings. This is covered by the second topic of this session.

The Session will focus on the following questions:

  • What are the enforcement limits of national and regional competition authorities in cross border competition cases and cases involving foreign market players?
  • What instruments are currently available to handle the above mentioned types of cases?
  • Could consultations under Section F of the UN Set help to satisfactorily handle cross border competition cases and cases involving foreign enterprises?
  • What are the benefits of networking in the exchange of non-confidential information in facilitating cooperation?
